This Puppy Sale Agreement (“Agreement”) is entered into between:

The Seller and the Buyer are hereinafter jointly referred to as the “Parties”.
The Parties agree as follows:
The Seller agrees to sell, and the Buyer agrees to purchase, a purebred Xoloitzcuintli (Mexican Hairless Dog) puppy.

Hereinafter referred to as the “Dog”.
2.1. The total purchase price of the Dog shall be agreed upon by the Parties and specified in this Agreement.

2.2. The Parties shall agree upon the payment schedule before signing this Agreement.
2.3. Any deposit or advance payment shall be recorded in the Agreement or in a separate payment confirmation.
2.4. Unless otherwise agreed in writing, all payments made toward the purchase price shall be considered part of the total purchase price.
2.5. The agreed payment schedule shall be binding upon both Parties.
2.6. The terms regarding the refundability or non-refundability of a deposit shall be agreed upon by the Parties and specified in this Agreement.
At the time of transfer, the Breeder confirms that the Dog:
The Breeder shall provide the Buyer with the available health, vaccination, identification and registration documentation relating to the Dog.
The Dog shall be sold under one of the following classifications, which shall be selected and expressly stated in the individual Agreement.
The Dog is sold as a Pet-Class / Companion Dog.
The Buyer acknowledges that the Dog is being purchased primarily as a companion animal and for home keeping.
The purchase of a Pet-Class Dog does not create any obligation for the Breeder to guarantee:
The Buyer acknowledges that the Dog may develop characteristics during growth that cannot be predicted with certainty at the time of sale.
The Dog is sold as a Show Prospect / Show-Purpose Dog.
The Breeder confirms that, at the time of sale, the Dog demonstrates characteristics considered suitable for potential participation in conformation dog shows.
The Buyer acknowledges that the designation “Show Prospect” does not constitute a guarantee of:
The realization of the Dog’s show potential depends on numerous factors, including growth and development, nutrition, health, socialization, training, handling, living conditions and participation in dog shows.
After the Dog has been transferred to the Buyer, the Breeder shall not be responsible for the Dog’s future show results, titles, placements or breeding value.
The Buyer confirms that they have been informed about the characteristics and specific needs of the Xoloitzcuintli breed.
The Buyer undertakes to provide the Dog with:
The Buyer shall comply with applicable animal welfare and veterinary requirements.
Ownership of the Dog and the risks associated with its life, health and keeping shall pass to the Buyer upon physical transfer of the Dog, unless otherwise agreed in writing.
From the moment of transfer, the Buyer shall be responsible for the Dog’s care, keeping, veterinary treatment and general welfare.
The Buyer acknowledges that the physical characteristics of a young dog may change during growth and development.
The Breeder shall not be responsible for future changes in characteristics including, but not limited to:
where such changes occur as part of normal growth and development or as a result of factors beyond the Breeder’s reasonable control.
The Breeder shall provide the Buyer with the documents and information available and necessary for the registration or issuance of the appropriate pedigree or export pedigree, where applicable.
Any fees charged by a kennel club, registry or other competent organisation shall be paid in accordance with the applicable requirements.
The Buyer shall provide the Breeder with any information and documents reasonably required for the completion of registration or pedigree procedures.
If the Buyer becomes unable or unwilling to keep the Dog, the Buyer shall inform the Breeder without undue delay.
Where possible, the Breeder shall be given the opportunity to assist in finding an appropriate new home for the Dog.
Any financial arrangements relating to the return, rehoming or transfer of the Dog shall be agreed separately by the Parties.
The Buyer shall not knowingly transfer the Dog to an animal shelter, rescue organisation or similar institution without first informing the Breeder and, where reasonably possible, giving the Breeder the opportunity to assist with alternative arrangements.
Any resale or transfer of the Dog shall be carried out responsibly and in accordance with applicable law and the welfare of the Dog.
Where required by a separate written agreement, the Buyer shall notify the Breeder before transferring the Dog to another owner.
The breeding status of the Dog shall be expressly stated in the individual Agreement.
Where the Dog is sold with breeding restrictions, the Buyer shall comply with those restrictions.
Where breeding is permitted, the Buyer remains responsible for ensuring that any breeding is carried out responsibly and in accordance with applicable laws, kennel club rules and animal welfare requirements.
The Parties agree to communicate honestly and in good faith.
Neither Party shall knowingly publish or distribute false or defamatory information concerning the other Party, the Dog, the kennel, its breeding programme or the circumstances of the sale.
This provision does not restrict either Party from making truthful statements, providing evidence to competent authorities, seeking legal advice, or exercising any legal right available under applicable law.
The method and timing of transportation shall be agreed upon by the Parties before the Dog is transferred.
The Breeder may assist the Buyer by providing information or contact details of a transporter.
Any transporter shall be agreed upon by the Parties in advance.
Unless otherwise agreed in writing, transportation costs shall not be included in the purchase price and shall be paid by the Buyer.
Where transportation is performed by an independent transporter, the transporter shall be responsible for the transportation services provided.
The Breeder shall not be responsible for circumstances occurring during transportation that are outside the Breeder’s reasonable control, unless otherwise agreed in writing or required by applicable law.
Neither Party shall be liable for failure or delay in performing their obligations under this Agreement where such failure or delay results from circumstances beyond their reasonable control and which could not reasonably have been foreseen or prevented.
The Parties shall first attempt to resolve any dispute arising from or relating to this Agreement through good-faith negotiations.
If the dispute cannot be resolved through negotiations, it shall be resolved in accordance with the applicable law and competent jurisdiction specified in the individual Agreement or otherwise applicable by law.
The Parties confirm that they have read this Agreement, understood its contents and voluntarily agree to its terms.
Any amendments or additional agreements shall be made in writing and agreed upon by both Parties.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in effect to the extent permitted by applicable law.
This Agreement may be executed in two copies, with each Party receiving one copy.
By signing this Agreement, the Parties confirm their acceptance of its terms.
